Terms of Use — Moodmo
These terms are the rules for using Moodmo. They apply to the Moodmo app for Android and iOS (package com.avillalva.moodmo) and to this website. Moodmo ("we", "us") provides them. By using the app or the website, you accept these terms. Our Privacy Policy explains how we handle your information.
In short
- Moodmo is a mood journal for self-reflection. It is not medical care, therapy or a crisis service.
- The core app is free. Premium adds encrypted sync, backup restore and extra themes.
- Purchases go through Google Play or the App Store. Subscriptions renew until you cancel them in the store.
- Your entries are yours. Keep backups with the export, and keep your passphrase and recovery key safe.
- Use the app fairly, and contact us first if something goes wrong.
1. Who can use Moodmo
You must be at least 13 years old, or the minimum age in your country, to use Moodmo. If you are under 18, you need a parent or guardian's permission to make purchases where your local law requires it. Moodmo is not directed to children under 13.
2. Not medical advice
Moodmo is a self-reflection and mood journaling tool. It is not a medical device, and it does not provide therapy, diagnosis or treatment. It is not a crisis service. Stats and insights in the app are for your information only.
If you are in crisis or thinking about harming yourself, contact your local emergency services or a crisis line right away.
3. Free features and Premium
Mood logging, stats, reminders, the app lock and data export are free.
Premium adds end-to-end encrypted sync across your devices, secure backup restore on a new phone and extra themes. Premium is available as a monthly or yearly subscription, or as a one-time lifetime purchase. Prices are shown in the store before you buy and may vary by country.
4. Payments, subscriptions and refunds
- Payments. Google Play or the App Store processes your purchase and payment, under their own terms.
- Automatic renewal. Subscriptions renew automatically until you cancel them in your store account settings. Cancel at least 24 hours before the renewal date to avoid the next charge. Cancellation takes effect at the end of the current period.
- Uninstalling does not cancel. Deleting the app does not cancel your subscription.
- Free trials. When a free trial is offered, it turns into a paid subscription unless you cancel before it ends.
- Refunds. Google or Apple handles refunds under their policies.
- Restore purchases. Use "Restore purchases" in the app to get Premium back, for example on a new phone. A lifetime purchase is tied to your store account.
5. Your account and your data
- Your content is yours. Your entries stay on your device unless you turn on sync.
- Backups. You are responsible for keeping backups. The app lets you export everything as a .zip backup or a .csv spreadsheet.
- Passphrase and recovery key. If you use sync and lose both your passphrase and your recovery key, your synced data cannot be recovered, and we cannot restore it.
- Lost data. Except where the law says otherwise, we are not responsible for data lost because of a lost device, uninstalling the app or lost credentials.
- Account. An account is optional and only needed for sync. You can delete it in the app in Profile > Delete account.
6. Your license and fair use
We give you a personal, non-exclusive, non-transferable and revocable license to use the app on devices you own or control, under these terms and the rules of the store you got it from. You agree not to:
- reverse engineer the app, except where the law allows it
- copy, resell or redistribute the app
- get around its security or Premium checks
- interfere with our servers or with other users
- scrape or access it with automated tools
- use it for anything unlawful
7. Our content and your feedback
We own the app, its design, the mood characters, the Moodmo brand and the code. If you send us feedback or ideas, we may use them freely, without any obligation to you.
8. Apple and Google
- These terms are between you and Moodmo, not Apple or Google.
- Apple and Google have no obligation to provide support or maintenance for the app.
- If the app does not work as described, you may notify the store to request a refund of the purchase price under its policy.
- We, not the stores, are responsible for handling any claims about the app.
- You confirm that you are not in a country under a US embargo and not on any US list of restricted parties.
- Apple and Google, and their subsidiaries, are third-party beneficiaries of these terms and may enforce them against you.
9. Third-party services
The app uses the services listed in our Privacy Policy, such as Supabase, RevenueCat, PostHog, Sentry, Expo, and Google and Apple sign-in. We cannot guarantee that they will always be available.
10. Changes and availability
We may change, suspend or discontinue features. We try to keep the app working well, but we do not guarantee it will be error-free or always available. The data on your device remains yours to export.
11. Ending these terms
You can stop using the app and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms. Sections that by their nature should continue, such as ownership, disclaimers, limitation of liability and governing law, still apply after that.
12. Disclaimers
To the extent permitted by law, Moodmo is provided "as is" and "as available", without warranties of any kind.
13. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data or profits. Our total liability for any claim is limited to the amount you paid us for Premium in the 12 months before the claim.
Nothing in these terms limits rights you have as a consumer that cannot be waived under your local law.
14. Indemnity
Where the law allows, you agree to cover claims against us caused by your misuse of the app or your breach of these terms.
15. Governing law and disputes
The laws of Mexico govern these terms. Before making any claim, please contact us by email and give us 30 days to try to resolve it informally. If we cannot resolve it, the competent courts of Mexico have jurisdiction.
If you are a consumer, you keep the mandatory protections of the law of the country where you live. For example, consumers in the EU may bring claims in their local courts.
16. Changes to these terms
If we change these terms, we will update the "Last updated" date above. For material changes, we will also let you know in the app. If you keep using Moodmo after the changes, you accept the new terms.
17. General
- Electronic communications. You agree that we can communicate with you electronically, for example in the app or by email.
- Severability. If any part of these terms cannot be enforced, the rest still applies.
- Entire agreement. These terms and our Privacy Policy are the whole agreement between you and us about Moodmo.
- No waiver. If we do not enforce a part of these terms right away, we do not give up the right to enforce it later.
- Assignment. If Moodmo is sold, merged or transferred, we may transfer these terms to the new owner, as described in the business transfers section of our Privacy Policy.
